CONFIRMED:PA "Samopomich" owes the city 371 355.32 thousand UAH
Public Association "Samopomich" owes to the territorial community of Lviv funds the amount of 366 605. 62 thousand UAH, and a penalty of 4 749. 7 thousand UAH.
THE CRUX OF THE MATTER:
Between "Samopomich" and the Office of Municipal Ownership Department of Economic Policy of Lviv City Council in 2016 concluded the lease of non-residential premises. However the PA"Samopomich" is not fulfilling its obligations under this agreement that led to the shortage of funds that had come in the budget of Lviv.
According to the legislation the contract of lease by its very nature is compensatory. One of the essential conditions of the contract is the rent that the tenant is obliged to pay monthly.
In accordance with the contract, "Samopomich" would have to pay every month 30 606. 62 thousand UAH. However, according to the reconciliation statement of mutual settlements, compiled on 15.07.2016 the Public Association "Samopomich" have a debt to the Department of Municipal Property of the Department of Economic Policy of Lviv City Council in the amount of 366 605.62 thousand UAH, and a penalty of 4 749. 07 thousand UAH.
LEGAL ASPECTS OF THE CASE:
Legal Department of NGO"Community Development" held a public inquiry, analysis and research all the facts. After proper examination of all the materials was sent the appeal the municipal property Department of the economic policy of the Lviv city Council with the requirement to recover funds from the Public Association "Samopomich" in the amount of 366 605. 62 thousand UAH and a penalty – 4 749. 07 thousand UAH. and to terminate the lease on the basis of malicious evasion from performing essential terms of the contract.
