Militaries of ATO are given free legal advice in hospital
One of the main problems is the status of combatants, which provides militaries of ATO with benefits. The process of getting a status is registered by Resolution of the Cabinet of Ministers on August 20, 2014 №413 and provides a long bureaucratic procedure.
Jurist -volunteers - Nazar and Irina give daily free consultations in hospitals, where the soldiers from ATO come. There are more than 200 people, who applied for them. The most burning issue of combatants shared with us the jurist - Nazar.
How individuals, who took part in anti-terrorist operations, receive the certificate of the participant of the warfare?
- To obtain the certificate of the participant of the warfare the person should submitt to the Commission of the Ministry of Defence of Ukraine a number of documents. To submit these documents to witness the status of the participant of warfare have the right the combatants or the commanders or other heads of agencies, institutions. If participants of ATO are released from military service, documents are served via regional military commissariat commission and city military commissariat of Kyiv.
What are the necessary documents for granting the status of combatants, persons, who took part in the ATO?
- Vacancies documents:
- Certificate of individuals directly involved in anti-terrorist operations, maintenance and protection of its independence, sovereignty and territorial integrity of Ukraine;
- Extracts of orders on drill of the arrival of the military tasks after antiterrorist operation;
- Extracts from orders to drill the first deputy head of the Antiterrorist Centre (Sector commander) on arrival for tasks antiterrorist operation and departure to the place of permanent deployment;
- Copies of certificates of travel (if any);
- Obtain copies of injuries (if any);
- A list of servicemen of the military unit A0000 Armed Forces of Ukraine, who defended the independence, sovereignty and territorial integrity of Ukraine.
List is made in alphabetical order and is available in paper and electronic form, the relevant documents have to be sent to the address: 03168, m. Kyiv, 168, Povitroflotsky Ave., 6, Personnel Policy Department of the Ministry of Defense of Ukraine. Also the electronical list in Microsoft Excel (version 97-2003) has to be sent to the automated control system of the Armed Forces of Ukraine "Dnepr" (if any) to the Deg_dkp@dod.ua».
What documents have to apply the participants of anti-terrorist operations and discharged from military service?
- Documents served by regional military commissariat commission and city military commissariat of Kyiv.
All documents submitted to the Commission for the Defense Ministry of Ukraine for determining combatants transferred to archival institutions in Ukraine for long-term (50 years) storage.
Commission of the Ministry of Defense of Ukraine on the definition of combatants learns all the documents and sends them for review by the Interdepartmental Commission for consideration of materials on the recognition of the combatants, and in the absence of grounds, which are confirmed by documents, return them to military units (agencies, departments), institutions, establishments for further improvement.
Which guarantees of legal and social protection have the citizens of Ukraine, who perform the constitutional duty of defending the homeland?
- Guarantees of legal and social protection of citizens of Ukraine, who perform the constitutional duty of defending the homeland, are provided in accordance with the laws of Ukraine "On the Armed Forces of Ukraine", "On social and legal protection of servicemen and their families", "On pensions for persons Discharged from military service and certain other persons","On state guarantees of social protection of servicemen, who are exempted from service in connection with the reform of the Armed Forces of Ukraine and members of their families "and other laws of Ukraine.
The payment of one-time financial assistance in the case of death (death), disability or partial disability without disability servicemen, reservists, who called up for training and special charges and reservists in the performance of duty in the military reserve is in order and under the terms established by the Law of Ukraine "On social and legal protection of servicemen and their families".
What is the procedure for obtaining land for participants of warfare?
- In accordance with Article 116 of the Land Code of Ukraine, all citizens of Ukraine are entitled to a one-time donation of land ownership, once for each type of use of lands of state and municipal property within the limits of free privatization, in the following amounts:
- For subsidiary farming - no more than 2.0 hectares;
- For gardening - no more than 0.12 hectares;
- For construction and maintenance of residential homes, commercial buildings (homestead section) in the villages - no more than 0.25 hectares,
in villages - no more than 0.15 hectares,
in cities - no more than 0.10 hectares;
- For individual country construction - no more than 0.10 hectares;
- For construction of individual garages - no more than 0.01 hectares.
Which documents are required to submit to the executive authority or local government areas at the location?
- Application: graphics, which indicate the desired location of the site;
- Approval of the land user - supplied only in cases where this area is to use another person;
- A copy of the passport;
- A copy of the identification number;
- A document confirming participation in the antiterrorist operation (license, certificate).
After receiving the necessary documents the appropriate body within the period not exceeding one month examine the request and permit or refuse to develop land management project.
